UMe IDX ("we," "our," or "us") provides branded IDX websites, MLS-connected property search, lead capture, messaging, and related tools for real estate professionals and the consumers who visit their sites (collectively, the "Service").
This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use UMe IDX, including our marketing website, agent/organization dashboards, and consumer-facing IDX sites powered by our platform. By using the Service, you consent to the practices described here.
2. Information We Collect
2.1 Information You Provide
We collect information you provide directly to us, including:
- Account information: Name, email address, password, phone number, and profile details for agents, brokers, organization admins, and other users
- Organization & business information: Brokerage or team name, branding assets, website settings, contact details, and related business configuration
- Lead & inquiry data: Information submitted through forms, chat, or other lead-capture tools (such as name, email, phone number, property interest, and message content)
- Search & preference data: Saved searches, favorites, alerts, and home-buying or renting preferences you choose to share
- Mobile number: Phone number you provide when you opt in to receive SMS/text messages
- Payment & billing information: Billing contact details and payment-related information processed by our payment providers (we do not store full payment card numbers on our servers)
- Communications: Support requests, feedback, and other messages you send us
2.2 Automatically Collected Information
When you use the Service, we automatically collect certain information, including:
- Device & log data: IP address, browser type, device type, operating system, access times, and referring URLs
- Usage data: Pages viewed, listings interacted with, features used, and similar activity on the Service
- Location data: Approximate location derived from IP address or, if you grant permission, more precise location used for map and search features
- Cookies & similar technologies: As described in Section 13
2.3 Information From Third Parties
We may receive listing, market, and related data from MLS and other data providers; payment and identity signals from billing providers; and analytics information from service partners that help us operate and improve the Service.
3. How We Use Your Information
We use the information we collect to:
- Provide, operate, and improve branded IDX sites, search, listings, lead tools, messaging, and related features
- Create and manage accounts for organizations, agents, and consumers
- Route inquiries and lead activity to the appropriate real estate professional or organization
- Send transactional notices, security alerts, product updates, and support messages
- Deliver SMS/text messages you have consented to receive
- Process subscriptions, payments, and billing
- Personalize content such as saved searches, alerts, and recommended listings
- Monitor usage, diagnose issues, prevent fraud and abuse, and secure the Service
- Comply with legal obligations and enforce our Terms of Service
4. How We Share Your Information
We do not sell your personal information. We may share information in the following circumstances:
4.1 Real Estate Organizations & Agents
If you submit an inquiry, create an account, or otherwise interact with an agent or organization site powered by UMe IDX, the information you provide may be shared with that organization and its authorized agents so they can respond to you and provide real estate services.
4.2 Service Providers
We may share information with vendors who help us operate the Service, such as hosting, analytics, email/SMS delivery, payment processing, customer support, and security providers. These providers may only use the information to perform services for us.
4.3 MLS & Listing Data Partners
Use of MLS and listing data is subject to applicable MLS rules and agreements. We may share limited usage or compliance-related information with MLS or data partners as required to provide IDX functionality and meet contractual obligations.
4.4 Legal Requirements
We may disclose information if required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of UMe IDX, our users, or others.
4.5 Business Transfers
In connection with a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction.
4.6 With Your Consent
We may share information with your explicit consent or at your direction.
4.7 Mobile Numbers
We do not sell, rent, or share mobile phone numbers with third parties or affiliates for their marketing or promotional purposes. Mobile numbers collected for SMS/text messaging are used only to deliver the messages you requested or consented to receive, and to provide related customer support.
5. SMS / Text Messaging
If you provide your mobile number and consent to receive SMS/text messages, we (and/or the real estate organization you are communicating with through UMe IDX) may send you transactional and/or informational messages related to your inquiries, account, property alerts, appointments, and similar service communications.
- Message frequency: Message frequency varies. You may receive recurring messages based on your activity and preferences (for example, when you request information, schedule a showing, or enable property alerts).
- Rates: Message and data rates may apply.
- Opt-out: You can opt out at any time by replying STOP. For help, reply HELP.
- Non-sharing: We will not share your mobile number with third parties or affiliates for their marketing or promotional purposes.
6. Data Security
We implement appropriate technical and organizational measures to protect personal information against unauthorized access, alteration, disclosure, or destruction. No method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
7. Your Rights and Choices
Depending on your location, you may have rights to:
- Access the personal information we hold about you
- Correct inaccurate or incomplete information
- Request deletion of your personal information
- Request a portable copy of your data
- Opt out of certain processing, marketing emails, or SMS messages
- Delete your account where that option is available
To exercise these rights, contact us using the details in Section 15. If your information was submitted through an agent or brokerage site, you may also need to contact that organization directly regarding their own records.
8. Data Retention
We retain personal information for as long as needed to provide the Service, fulfill the purposes described in this Privacy Policy, meet legal and contractual requirements (including MLS and billing obligations), resolve disputes, and enforce our agreements. When information is no longer needed, we delete or anonymize it where reasonably practicable.
9. Children's Privacy
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us so we can take appropriate action.
10. International Data Transfers
UMe IDX is operated from the United States. If you access the Service from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries where our service providers operate. Those countries may have different data-protection laws than your home country.
11. California Privacy Rights
If you are a California resident, you may have rights under the California Consumer Privacy Act (CCPA/CPRA), including the right to know what personal information we collect, request deletion, and opt out of the “sale” or “sharing” of personal information. We do not sell personal information. To make a request, contact us using the details below.
12. European Privacy Rights
If you are located in the European Economic Area, United Kingdom, or a similar jurisdiction, you may have rights under applicable data-protection law (such as GDPR), including access, rectification, erasure, restriction, objection, and data portability. Our legal bases for processing may include your consent, performance of a contract, legal obligations, and legitimate interests in operating and securing the Service.
13. Cookies and Tracking Technologies
We use cookies and similar technologies to keep you signed in, remember preferences, measure traffic and performance, and improve the Service. You can control cookies through your browser settings. Disabling certain cookies may limit some features of the Service.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will post the updated policy on this page and revise the “Last updated” date. Continued use of the Service after changes become effective constitutes acceptance of the updated policy.
